This software is licensed by Flexeshower Pty Limited ("Flexeshower"). The software is provided on the terms and conditions set out in the End User Licence Agreement (EULA) which is posted on our website. Warranties are as set out in that Agreement. To the extent permitted by law, Flexeshower excludes any implied warranties, conditions and terms including the implied warranties of merchantability and fitness for a particular purpose. Flexeshower shall not be liable to you or to any third party for any damages arising out of your use of the software, whether arising in negligence, breach of contract or otherwise, including damages for special, incidental, consequential or indirect loss of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, loss of data, loss of profit or product, loss of revenue, loss of business, loss of anticipated savings, loss of goodwill, lost opportunity and claims by third parties, whether or not Flexeshower has been advised of the possibility of such damages.
Trial periods are to be utilised for user acceptance testing to ensure that the software functions and performs to meet your minimum operating standards and procedures. This subscription is confirmation that full and complete user acceptance testing has been completed to your absolute satisfaction.
Subscription will automatically renew unless written notice of termination is sent 30 days prior to the commencement of the next renewal term.
